This document explains what personal information we collect, how we use it, who we share it with, and the rights you have. It applies to the website theagensee.com and the related services we provide. Where customer operational data is concerned, our default posture is data minimisation: we do not collect what we do not need, and we do not retain what we no longer need.
Who we are
The Agensee is a Canadian operating entity providing managed AI services on dedicated hardware deployed in customer premises. References to "we," "us," and "our" mean The Agensee; references to "you" mean the website visitor or, where the context requires, our customer.
Our registered office address and contact details are listed on the About page and at the foot of this document.
Information we collect
We collect three categories of information.
- Web form submissions. When you submit the contact form, the discovery-call form, or any other form on this website, we collect the fields you fill in (typically name, email, company name, and a free-text message).
- Support and account communications. When you write to us by email or via account channels, we keep a record of those communications and any attachments you send.
- Limited website analytics. We use a privacy-respecting analytics tool (Plausible / Fathom or equivalent) that records aggregate usage — pages viewed, country, referring source — without cookies or individual tracking. We do not use Meta Pixel, Google Ads tracking, or comparable cross-site identifiers.
We do not collect personal information about your customers through this website. That kind of information — your inboxes, your client records, your operational files — is processed by your Agensee unit, on your premises, and is governed by the Data Processing Agreement (DPA) attached to your service contract.
How we use your information
We use the information we collect to respond to your enquiries, deliver and improve our services, send the communications you have asked for, fulfil our contractual and legal obligations, and detect and prevent fraud or abuse. We do not sell personal information, and we do not share it with advertisers.
Our role with respect to customer operational data
For your operational data — anything the AI works with on your unit, including files, inboxes, and Knowledge Base contents — you are the data controller and we are the data processor acting on your written instructions, as defined in our DPA.
For the data described in the previous section (website forms, support communications, website analytics), we act as the data controller.
Sub-processors
We engage a small number of carefully vetted sub-processors. Each is bound by contractual confidentiality and data-protection terms that meet or exceed our commitments under this policy.
- Anthropic PBC — Claude API (under our Commercial Partner agreement; enterprise terms; customer data not used for model training).
- Microsoft Corporation — Microsoft 365 services where the customer has elected to receive them under our CSP partnership.
- Hosting and infrastructure provider — for the marketing website and account portal (named on request).
- Tailscale Inc. — for the secure VPN tunnel used to support and maintain your unit.
- Web3Forms — relays website contact-form submissions to our inbox; receives the name, email, company, and message you enter.
We maintain a current sub-processor list and will notify customers of material changes in line with the DPA.
Data retention
Web-form submissions are retained for up to 24 months after the last related interaction unless you ask us to delete them earlier. Support communications are retained for the life of the customer relationship plus seven years, in line with our tax and accounting obligations. Website analytics are aggregated and contain no individual identifiers.
Customer operational data lives on your dedicated unit and is governed by the DPA. On contract termination, we export your Knowledge Base to you in a structured format and the unit is returned or wiped to factory state.
Your rights
Subject to applicable law, you have the right to access the personal information we hold about you, request correction or deletion, object to or restrict certain processing, and withdraw any consent you have given. To exercise any of these rights, contact our Privacy Officer at info@theagensee.com. We will not charge you for a reasonable request.
Quebec residents · Loi 25
For customers and visitors in Quebec, we comply with the Act respecting the protection of personal information in the private sector (Loi 25). We have designated a Privacy Officer (info@theagensee.com), we maintain a Privacy Impact Assessment for every Skill we offer to customers, and we operate a 72-hour breach-notification runbook in line with our regulator's expectations.
Children's and student information
Where our services are used in an educational setting, any student personal information is processed on the instructions of the school as data controller, on a data-minimisation basis — only what is necessary for educational and operational purposes. For students who are minors, processing relies on consent obtained by the school from a parent or legal guardian, which may be withdrawn at any time. We do not use student information for advertising and do not sell it.
In our pilot school (Académie Lavalloise), we obtained explicit, informed parental consent through an addendum to the educational-services contract, in line with Quebec's Law 25. That consent covers the use of AI tools to optimise school operations, on a data-minimisation basis.
International transfers
Where personal information is transferred outside Canada (for example to our US-based sub-processors), we rely on contractual safeguards that provide an equivalent level of protection to the law applicable to you.
Changes to this policy
We may update this policy from time to time. Material changes will be notified on this page with a revised "last updated" date and, where the change is significant, by direct communication to customers.
